Reckless and Negligent Driving

Yesterday, on my way home from work, travelling my usual route, I almost became a statistic. Travelling up Kloof Street, from the Orange, Kloof, Long Street intersection (Long Street baths on the Corner), approximately 200 metres up the road, a smarty pants in his brand new CLK 500 Mercedes decides to turn across my path, no indicator to boot - stopping to wait for the electronic access gate to fully open to the Parking lot he wishes to enter. Was it not for the skills many of you have taught me, I would not have been able to control the slide I went into or have been able to stop in time, avoiding this unexpected obstacle. On turning around and questioning the smarty-pants, he was surprised to see a slightly enraged biker at his car door, still completely unaware of what had just transpired. "Didn't you see me" was answered with "What?". "Do you know I almost just crashed into you because you crossed the road infront of me" was met with "I didn't see you" "What the @#$% were you thinking!!" was met with a blank stare... I then proceeded to take out my cellphone camera to take photos of this expensive car (not because I'm a fan, but it's easier than writing the license plate and car details down) and one of my personal smarty-pants for indentification later - to his response of "do you want me to smile for the photo?" Luckily, even with the arrogance of this middle aged, above the wealth gap, white male smarty-pants. Even with the blatant indifference at the fact that he could have caused me serious bodily harm, nevermind the property damages - I managed to maintain my cool (only damn well just). I proceeded to the Cape Town Police station and have since laid a charge of Reckless and Negligent Driving. Case number 849/03/2009. I'm not willing to simply accept that he "did not see me". It was on a straight piece of road, visibility was good, I am not riding the smallest of motorcycles, the road was clear barring me travelling up it.

Alan Well done on (sort of) keeping your cool, and keep us updated on the progress of your case - remember, by reporting this, you (we) CAn make a difference - he will no doubt relay the 'case' info to say a dozen friends or so, and word will spread to take greater care, hopefully. At least yo know where he lives or works, should you need to contact him again. For what it's worth, I followed a Silver CLK Merc 500 along the coast road from Llandudno to Camps Bay - he was OBLIVIOUS to the cars behind him, (I was in my cage) and was driving well below the speed limit, and not driving well at all. I overtook him and got clear; this driver was a menace... http://www.themanorcottage.co.za

Well Done ! Alan, I know what it is like, in fact I think we all do, it really isn't easy to keep your cool, especially when the adrenalin is pumping after a near terrible experience. But... RESPECT my friend, BIG RESPECT. Keep us posted on the events that transpire. I'm sure with the amount of wealth, he will get a good lawyer and a slight slap on the wrist. me thinks someone was going to fast aswell. 200m should give anyrider in a car/bike traveling at the speed limit more than enough time to stop.(just asking) I am not condoling the actions of the idiot that drove in front of you and stopped, but hey maybe he thought because you were 200m away he could still make it. the sad thing is that, what happened to you will not be the last. as long as there are people driving without depth-perception this will happen. I hope you get the oke. and that it makes some news story so that it can send some type of message out there that it will not be taken lightly when you endanger those around you...

Hey There 1200GSADV, The length of road from robot to location is about 200m, from robot to my street is +-230m. This idiot turned at about 20m from me. This may not be the last time it happens, but it may be the first prosecutory act (my own word, yes) that paves the way for awareness and for a workable recourse to remove and / or limit the rate of occurence :)

Alan ,I am glad you are ok . Great on your good reflexes. I agree that everyone should have a right to lay a criminal charge , and have their case prosecuted, even if it is only for a relatively small transgression . The only problem with this is the sad reality that our police stations and courts are so understaffed and under-funded that there is a backlog of years . This means that murder victims , culpable homocide victims ( eg deaths /accidents caused by drunk drivers) and rape victims etc are already waiting at least two years for their cases to be heard. Every "smaller" case just slots into this same backlog and only helps to delay justice for the more serious crimes. If you nevertheless decide to proceed ,you might find the police and prosecutors do not take you very seriously , as their attention is on the serious crimes, and this might frustrate you even more. Good man. I think it's a great idea. Laying charges amy not amount to anything - but soon word will spread that bikers are not accepting the ' I didn't see you' excuse. It might, just might, make drivers more aware. People have a fear of being sued.
There are so many problems in this world. Luckily there's a wristband available for almost all of them.

Yes Reinette You are quite right, and not to mention the 'fine' Allan will need to pay to see justice done (i.e. legal fees if he seeks legal aid in getting his justice). But, somehow, if Allan had gotten off his bike, and hit the miscreant on his nose - then suddenly, the law is swift to act, never mind all the murder and rape victims in the queue fading from two years of sun and rain. I'm sure that case was put on the trash pile the moment you walk out of the police station :-) Dude, perhaps the best thing to do is just accept that people are bad drivers and if you see a car, taxi or another bike just anticipate the stupid moves people make on the road. Getting all hyped-up about it is not good for your health :-) Lately it seems you have a really bad time on the road man! "breaking off taxi mirrors" "pedestrians on the N1" "Merc drivers p&$Ssing you off" What's next :-) PS. I'm just pulling your leg... Regards, Corné

Thanks for the input guys, I know that, for the most part, nothing will come of this. I agree with Charles, Reinette and Corne - but I know that if I hadn't taken the effort to lay the charge, I would have been in the chookie for blikse@#$) him... Even if all that happens is that Constable Matthys (the investigating officer) phones my Smarty-pants to hear his side of the story etc - hopefully it'll skrik him into waking up. Unlike Chris, who was able to harvest almost immediate, positive results with regards to his close call, I have no further updates on this case presently, which is a pity really - if I hear anything, I'll let you all know. Does anybody know what's come of Jane's accident story?
